Abstract

The background of this article is the country of Indonesia adopts a rule of law, as where it is in the explanation of the Constitution in 1945 as follows: "Indonesia is a State based on law, not based on power alone". So, It is interesting in researching, studying and discussing the using evidence pledge and it’s=ole according to civil law procedure in court. Data obtained from relevant documentation using display analysis, data verification and conclusion.
The results showed that the use of oaths as evidence in a court of justice carried out based on the rules set out in the civil procedural law in accordance with article 155 HIR, Article 182 R.Bg. Article 1 940 BW concerning the supplementary oath article 156 HIR, article 183 RBg, 1930 BW regarding decissoir oaths (breakers). The implementation has a difference, where the suppletoir oath still requires other evidence to strengthen the arguments of the parties in litigation while the decissoir oath functions not only to strengthen the arguments, but also becomes a strong reason for the judge to sue immediately end a matter. Besides, the role of oath evidence is not too important with other evidence, because if each evidence presented in court, can support the arguments of the lawsuit, then immediately the judges of the court will immediately draw conclusions and pour them into decisions that are of a nature binding, contains the power of proof and has the power to be implemented (executorial). Moreover, considering that, this oath evidence has a role which is no less important than other evidences, it is expected that the judges will still use the oath as evidence to decide on a civil case, eventhough there are some experts who do not list the oath as evidence.
