RIBA IN ISLAMIC LEGAL THINKING PERSPECTIVE

Abstract

The aim of this paper is to understand the ban on usury in Islam, and to find out about the grouping of the usury.Islam as a religion that is universal and comprehensive, has arranged the issue of usury, either through the Qur'an and Hadith as the main source. Comprehensive Islam is more complete with expert interpretation of Islamic law scholars on the subject of usury. Muslims prohibits any form of usury. Because this is contrary to the teachings of Islam. The ban can be found in the Qur'an and hadith. Sebagaiman described in Chapter III that the prohibition of usury down into four stages, Stage One, Islam rejects usurious loans that seemed to help, when in fact harm. Second Stage, usury portrayed as something bad and Allah. Threaten and reward hard to Jews who remain devour usury. Third stage, usury is forbidden because it doubled. The fourth stage (last) God absolutely forbids any kind of usury.

Broadly speaking usury grouped into two,  each is usury and usury accounts payable of sale. Usury is usury debts arising Because of the borrowing and lending transactions. Riba buying and selling that is usury trangsaksi arising from the purchase. The first group (usury debts) divided into qardh usury and usury jahiliyyah. The second group (riba buying and selling), is divided into usury and usury nasi'ah Fadl.

Abstract

According to Financial Theory, asset price is equivalent to the (expected) current discounted value of its dividends, i.e., its market fundamental. Fluctuations in asset prices are considered keeping this in mind (Leroy and Porter [25] and Shiller [32, 33]). Assets will be valued according to their market fundamentals (Tirole:1982: 1163-1181) When the price of asset is inflated due to high demand asset bubble occurs. High money supply and liquidity in the financial system fuels a bubble growth as it allows people to invest more money and allows investors to leverage their capital (borrowing from the banks and further investing in assets). Excessive money supply and liquidity is one of the main causes of asset bubble as investors invest more money on assets taking easy loans from banks. New investors especially those who took bank loans suffered most during the last global asset bubble especially in Japan (1986-1991) and during the recent housing bubble in the USA (2007). Monetary policy as well as financial system analysis is a vital instrument for dealing with the problem. In fact when deviation occurs in stock valuation from its basic value, asset price bubble happens (Fischer and Merton (1984). When stock is overvalued firms start to invest more. In this paper we will see how central banks should deal with the asset price bubble with an experience from the globe especially from Japanese and USA asset and housing bubbles. Asset bubble in turn raises prices of housing purchases, art objects, land equities etc. Goodhart (2001, P335-p356) endorses this conclusion.

Abstract

The concept of preference is used quite alot today. Individuals with disabilities also have preferences. In this study, the relationship between order of food pereference and consumption frequency of individuals with intellectual disabilities has been investigated according to parental views. In this study thirty-five parents of children at seven-fourteen years of age participated in the diagnosis of intellectual disabilities. According to the research results, a relationship has been found between the food items preffered by the individuals with intellectual disabilities and their consumption frequency of these items at different levels.
