IN SUPPORTING GOVERNMENT MANAGEMENT EFFECTIVENESS
(CASE STUDY IN PRESIDENTIAL OFFICE 2009-2014)

Abstract

Research on governance pattern in presidential institution in order to support government is an important issue in public administration. The condition illustrates the directive relations within the institutional process framework of presidential and vice presidential program execution in fulfilling their campaign promises. Governance pattern analysis in presidential institution is related to the effectiveness of presidential institution governance with regard to show the people on the performance of the presidential institution in delivering their tasks of government.  
Research design applied is qualitative research. Research data related to the institutional effectiveness within the presidential institutions such as Ministry of the State Secretariat, Cabinet Secretariat, and Presidential Working Unit for the Supervision and Management of Development (UKP4) from 2009 until 2014. Data collection techniques are depth interview toward several related informant, and secondary data. Analysis focused on coordination, organization, government and bureaucracy management.
Based on the result of analysis, research shows that the effective governance pattern of presidential institution in supporting SBY-Boediono regime determined by the existing of integrated coordination, not overlapped organization, effective government management, and professional bureaucracy.

CIVIL STATE APPARATUS NEUTRALITY
(A STUDY OF DIRECT LOCAL HEAD ELECTION IMPLEMENTATION
IN BANJAR REGENCY, SOUTH KALIMANTAN PROVINCE)

Abstract

There is a case of  State Civil Apparatus non-neutrality in Banjar regency at the time of local head election in 2015. This case appealed to the author to be studied further where at that time the government is trying to implement the contents of Law No. 5 of 2014. In this research, the authors raised the issue of the State Civil Apparatus neutrality, especially the Neutrality of Banjar Regency Work Unit Head on local head election 2015.
While research method used in this research use descriptive research method with qualitative approach. The local government of Banjar regency must have a way to prevent the bureaucracy from engaging in political activities during the elections.
The results of this study indicate that there is an intervention of a bureaucratic apparatus who served as a head to his subordinates. Then that  factors cause bureaucratic apparatus non-neutrality  among others are weak supervision, weakness of law enforcement, ambiguity of neutrality meaning`, desire of power, intervention and influence of leadership, political maneuver, solidarity and fraternity. While research method used in this research use descriptive research method with qualitative approach. Banjar Regency Local Government must have a way to prevent the bureaucracy from engaging in political activities during Local head ellection.

CONTRIBUTION TO THE LEGAL ENVIRONMENT OF THE CONTRACTUAL NEGOTIATION

Abstract

The image of a contract which is formed in an instant of reason by the meeting of offer and acceptance probably corresponds to a good deal of contractual life, especially in the contracts of everyday life. However, this reality does not reflect the totality of the contracts. Where the interests involved are important, for example in the case of prospecting contracts and the extraction of underground wealth, long-term supply contract, major works contract, sale of industrial complexes , of technology transfer ... In these different contracts, the conclusion of the contract is almost always preceded by a long period of negotiation. The French Civil Code and the Vienna Convention on International Sales are all silent on this important period, which is regulated by case law. If this period is governed by the sacrosanct principle of contractual freedom, the fact remains that it is framed. In this phase also, it is not excluded that the parties sign a preparatory contract whose objective is to reach a definitive contract in the future.
